Whenever an Order is entered for child support, the Court is required to assign responsibility for providing medical insurance for the children, and to specify the percentage that each parent shall pay for any medical, dental and/or vision costs of the children which are not covered by insurance.
The Arizona Child Support guidelines provide the timeframes for reimbursement requests and for payment. Except for good cause show, any request for payment or reimbursement of uninsured medical, dental and/or vision costs most be provided to the other parent within 180 days after the date the services occur.
The parent responsible for payment or reimbursement must pay his or her share, as ordered by the court, or make acceptable payment arrangements with the provider or person entitled to reimbursement within 45 days after receipt of the request.
The guidelines mandate that both parents should use their best efforts to obtain services that are covered by the insurance.
Upon a reasonable request, a parent who is entitled to receive reimbursement from the other parent for medical costs not covered by insurance is required to provide receipts or other evidence of payments actually made.
It is usually a good idea to provide good documentation at the time of making a request for reimbursement, as the other parent is likely more receptive to providing reimbursement if they feel that the charges are valid and have been paid.
Another consideration is that if parents have joint legal decision making then they both should have input into non-emergency decisions such as braces. This may be a matter of form over substance. Even if medically necessary and thus unavoidable, parents are usually more receptive to the charge if they have had some advance warning.
