Some parties are not ready to divorce but wish to live separate and apart and have clearly defined legal rights. Arizona provides for a legal separation where both parties agree to the legal separation, as opposed to the divorce.
The procedures for a legal separation are similar to those in a divorce whereby the court divides the parties assets and debts and enter any appropriate custody or support orders. And while the parties are still legally married at the conclusion of the process, important and binding orders are usually entered in virtually all other aspects, as though they were divorced, including a division of their property and debt division, spousal maintenance, etc.
Since the parties in a legal separation remain married, they cannot remarry. However, a legal separation can later be converted to a dissolution. Parties can usually remain on their spouses health insurance if they are legally separated but can be protected from the future debts of the other spouse.
